I guess if you walked into a court room without representation against someone that had representation with them, unfortunately, you're likely on the loosing side. I only say that because without representation against someone that knows what's going on and what to say and do, you're immediately at a disadvantage. Sorry to hear about the results.
Everybody else lists their cars here - but not me.

I have too many to count

CoolAirVw wrote:You need an expert to go with you who can testify on your behalf that they evaluated the failure and it was caused by shoddy workmanship on Diesel Specialists part. Listing of heater cores, heater controls, dirty car, ect will mean nothing to the case in point to the judge.

Your opinoin of what caused the failure is negated by the fact that you are not an expert (demonstrated by the fact you paid them to install the motor and paid them to diagnose and install the injection pump). And obviously your biased to your side. I'm not knocking you in anyway, I'm just giving you advise on how to win in court.

Its your responsibility to prove they are liable. The judge wont investigate. To win YOU need to present a winning case based on facts or expert opinions. The judge wont understand that a broken timing belt causes pistons to crash the valves.

Note: Diesel Specialists may be able to be thier own "expert witness" but its negated by your expert witness because they are obviously biased.

Did you read anything I said? I want to restress "expert to go with you" and "expert opinion".
oldjetta wrote:We did call Jack Ewald to testify by phone but the judge denied his testimony because we could not independently verify his identity and swear him in.
Did Jack even look at the car after the failure? Aren't you in florida? Jack is in Ohio? How can he testify to anything if he didn't look at the car? Anyone could've told you that telephone witness's are not allowed in court.
oldjetta wrote:Also, I was cross examined by both sides but was not permitted to provide a free flow testimony as was permitted for Diesel Specialists

How is it that everything that Diesel Specialists had to say was acceptable but what I had to say was not?
Because he can be considered an expert, you are not an expert. All that you can testify to is the timeline of when he worked on it and when it failed. (which is circumstancial evidence, meaning its irrelevant)
